Foundation Agreement

Article 10 Property

3. In areas not subject to territorial adjustment, the arrangements for the exercise of property rights, by way of reinstatement or compensation, shall have the following basic features:

e. Properties not covered by the above shall be reinstated five years after entry into force of this Agreement (three years for vacant properties), provided that no more than 10% of the area and residences in either constituent state and 20%3 in any given municipality or village (other than villages specifically designated in this Agreement) shall be reinstated to owners from the other constituent state; and

3 Note: These percentages are directly related to the agreed territorial adjustment.

Comments

This is blatant confirmation that Kofi Annan has all the long sought to create an a Apartheid state and prevent the refugees from ever returning. This article not only violates the principles and charter of the United Nations which Mr Annan purports to represent but is a deliberate violation of existing UN resolutions, the judgement of the European Court of Human Rights and the European Convention of Human Rights and all international human rights norms, but is racist, divisive, illegal, legally unenforceable and a travesty of justice. It must be struck out entirely.

Amendment Required

“3. All areas will subject to return to the Republic of Cyprus to its satisfaction before the constitutional, governmental and institutional changes foreseen by agreement can take effect. Properties shall immediately be reinstated to all dispossessed owners on the basis of ownership in accordance with the law without delay or deliberation”

e. All properties will be reinstated to their legal disposed owners without delay in accordance with the law; and”
