Foundation Agreement

Article 13 Entry into force and implementation

1. This Agreement shall enter into force at 00:00 hours on the day following confirmed approval by each side at separate simultaneous referenda conducted in accordance with the Agreement.

Comments

There is no guarantee given that Turkey will comply with any of its obligations under the agreement. It is has already been violating over 130 UN Security Council resolutions for over 40 years so how can it be trusted. Therefore the agreement should not come into force unless all Turkish troops and colonists have been removed from Cyprus soil. 

There is also no mechanism provided for the refugees to take part in the democratic process and exercise their vote in the region their homes are located therefore all the refugees must also be allowed to return to their homes and have been fully resettled as demanded by existing UN resolutions before the agreement can come into force.

Amendment Required

1. This Agreement shall NOT enter into force until all Turkish troops and colonists have been removed from Cyprus soil and all refugees have freely returned to their homes in safety to their full and just satisfaction.
