Foundation Agreement
Article 4 Fundamental rights and
liberties
1. Respect for human rights and
fundamental freedoms shall be enshrined in the Constitution. There shall be
no discrimination against any person on the basis of his or her gender,
ethnic or religious identity, or internal constituent state citizenship
status. Freedom of movement and freedom of residence may be limited only
where expressly provided for in this Agreement. |
Comments
This paragraph not only contradicts itself but it is contradicted by the provisions of the previous articles in the Annan plan and the ones which follow. How can Mr Annan claim in one sentance that the constitution enshrines respect for human rights, fundamental freedoms and non discrimination, when in the next sentence he seeks to derogate them on a totally illegal, unjustifiable and discriminatory basis whcih is unenforceable in international law.
The notion of so-called constituent state citizenship is totally incompatible with the idea of a Federation. A federal state does not vest the constituent states with the right to grant citizenship. As a resident of California for example, as person is a California resident and not a California citizen.
Article 4. 1 must be amended as follows so that there are no more contractions and it complies with international law.
