Foundation Agreement

Article 7 Transitional federal institutions

3. Constituent state legislatures to be elected within 40 days of entry into force of this Agreement shall each nominate 24 delegates (reflecting the political composition of their legislature) to a transitional federal Parliament to operate for one year.

Comments

This is completely incompatible with the basis of a federation. In a federation the constituent states derive their authority from the federal state and not the opposite. In a federation the federal parliament must be freely elected directly by the people and not appointed by the constituent states. The above paragraph must therefore be amended so that is compatible with UN resolutions which call for a federation and not a confederation.

It is impossible hold any kind of election campaign which will reach all the people or for the whole of the people including the refugees and displaced persons to freely elect any kind of legislature or parliament and for that legislature or parliament to exercise its powers while Cyprus remains occupied by 40,000 illegal Turkish troops and up to 150,000 illegal Turkish colonists and the refugees and displaced persons have not been able to return to their homes should they so wish or been resettled, therefore this agreement and the changes made by it can only come into force when all Turkish troops and colonists have been removed from Cyprus soil and all refugees have returned to their homes in safety as demanded by UN resolutions and everyone has settled down and a state wide communications infrastructure has been established. Then and only then can elections truly be free and take place democratically and thus there will be no need for any kind of transitional parliament.

3. The Senate and Chamber of Deputies of 62 members are to be freely elected within 40 days of entry into force of this Agreement. They shall nominate 24 delegates (reflecting the political composition of the Chamber of Deputies) to each constituent-state legislature to operate for one year.
