Foundation Agreement

 

Article 1

 

3. The Treaty of Establishment, the Treaty of Guarantee, and the Treaty of Alliance remain in force and shall apply mutatis mutandis to the new state of affairs. Upon entry into force of this Agreement, Cyprus shall sign a Treaty with Greece, Turkey and the United Kingdom on matters related to the new state of affairs in Cyprus, along with additional protocols to the Treaties of Establishment, Guarantee and Alliance.

 

Comments

In order for the Annan plan to be viable the people of Cyprus need to feel secure and have their security guaranteed.

The Treaty of Establishment, the Treaty of Guarantee, and the Treaty of Alliance allowed Greece to orchestrate a coup at the behest of the CIA against the democratically elected president of the Republic of Cyprus, on the orders of Henry Kissinger who wanted him murdered. These treaties contributed to the illegal Turkish invasion of Cyprus in violation of Article 2 Paragraph 4 of the UN Charter as stated in numerous UN resolutions. The US conspired with NATO so that no action was taken to stop Turkeys illegal invasion and to the contrary NATO documents reveal that it supported the assassination attempt against President Makarios and the illegal invasion knowing that brutal ethnic cleansing was being perpetrated by Turkey. Britain failed in its obligation to protect Cyprus due to the intervention of Henry Kissinger who ordered James Callahan not to allow the Royal Navy to stop Turkey when it violated a UN brokered cease fire on August 14 1974 and invaded Cyprus a second time in the same year. Because of this 200,000 Greek Cypriots were ethnically cleansed and thousands were massacred, tortured and mutilated, raped, murdered, or made to disappear by the Turkish forces as documented in the Reports of the European Commission of Human Rights which found that Turkey alone was guilty of mass violations of the European Convention of Human Rights.

The Treaty of Establishment, the Treaty of Guarantee, and the Treaty of Alliance along with the guarantor powers rather than guaranteeing Cyprus sovereignty, independence and territorial integrity have undermined it. The Annan plan which maintains and strengthens the rights of the guarantor powers which betrayed Cyprus ignores the lessons of history and fails to contribute to Cyprus security.

Turkey does not recognise the Republic of Cyprus nor has it shown any intention of respecting its unity, independence, sovereignty, and territorial integrity for over 30 years. Since 1964 Turkey has repeatedly failed to comply with over 130 UN Security Council Resolutions concerning Cyprus and numerous European Court of Human Right judgments ordering to unconditionally compensate the Cypriot victims of its human rights violations and allow the refugees to retune to their homes in safety. How can Cyprus be expected to sign a treaty with a state that does not recognise it and holds the UN and ECHR in utter contempt, let alone rely on this state to guarantee its security.

Article 1 Paragraph 3 by relying on a failed system of guarantees and by ignoring recent history  is incapable of  giving the Cypriot people the security they need.

The Treaty of Establishment, the Treaty of Guarantee, and the Treaty of Alliance must be replaced be new treaties and new guarantees and guarantors which Cyprus can rely on. The most reliable guarantor of Cyprus security is Cyprus itself. The UN was powerless and incapable of stopping the two Turkish invasion of 1974, and none of the existing guarantor powers can be trusted either individually or collectively to protect Cyprus nor can NATO.

Besides that the Treaty of Establishment, the Treaty of Guarantee, and the Treaty of Alliance are all incompatible with Cyprus EU membership. A member of the EU cannot have guarantors when the EU is its own guarantor. Cyprus is already a member of the ESDP initiative and is bound by its obligations under that. Cyprus should be incorporated into a single European defence structure which maintains a mutually binding clause on aggression that states that an attack on one member state is an attack on all members This should become the basis of Cyprus guarantee along with its own defence force and the Charter of the United Nations.

Taking the above into consideration it is unthinkable that Article 1 Paragraph 3 can be accepted as it stands and must be amended.

The Treaty of Establishment, the Treaty of Guarantee, and the Treaty of Alliance will all be abolished and become null and void and in view of Cyprus joining the EU in May 2004 the European Union and United Nations Security Council will undertake responsibility as guarantors of Cyprus independence, sovereignty and territorial integrity.”
