Foundation Agreement
Article 7
Transitional federal institutions
1. The federal institutions shall evolve
during transitional periods, after which these institutions shall operate as described
above. 2. Upon entry into force of this
Agreement, the leaders of the two sides shall become Co-Presidents of the
United Cyprus Republic for thirty calendar months. Each Co-President shall be
confirmed by their respective constituent state legislature, which may
instead elect another person as Co-President, and which shall elect a
replacement should the office of Co-President fall vacant. The Co-Presidents
shall exercise the executive power during the first year, assisted by a
Council of Ministers which they shall appoint. For the following eighteen
months, the executive power shall be exercised by a Council of Ministers
elected by Parliament, and the Co-Presidents shall together hold the office
of Head of State. |
Comments
This is arrangement is completely unworkable and will not guarantee Cyprus security or the rights of its people and a Turkish withdrawal.
Turkey has repeatedly proven that its word cannot be trusted. On August 14 1974 Turkey without provocation violated a UN brokered ceasefire and proceed to brutally ethnically cleanse 200,000 Greek Cypriots from their homes in 38% of Cyprus territory. Turkey’s crimes against humanity were not reciprocated by the people of Cyprus and are summed up in the first and second and third reports of the European Commission of Human Rights and the Judgments of the European Court of Human Rights for which Turkey has been condemned by the Council of Europe for refusing to implement.
There must therefore be no recognition of any of the institution or territorial adjustments made by this agreement until all Turkish troops and colonists have been removed from Cypriot soil and all the refugees have returned to their homes in safety or have received payment of compensation in full and just satisfaction.
Turkey still refuses to recognise the Republic of Cyprus. The Republic of Cyprus must be recognised by Turkey and allowed to exercise its authority throughout all of the territory of Cyprus which is demanded by the Resolutions of the UN, EU, and the judgments European Court of Human Rights, under the terms of the present 1960 constitution before this agreement can be enacted.
During the transitional period the Cyprus government should delegate authority over the occupied areas to the United Nations for the duration which must be a short as possible. Nine months should be enough time for all Turkish troops and colonists to be removed from Cyprus soil though longer will be required for all of the refugees to return.
Kofi Annan must amend Article 7 Paragraphs 1 and 2 as follows so that they comply with international law and the resolutions of his own organisation.
Amendment Required
1. This Agreement
and its organs shall not enter into force until all illegal Turkish Troops and
Colonists have been removed from Cyprus soil and all refugees can return to
their homes in safety as called for by the resolutions of the United Nations, the
European Union, and the judgments of the European Court of Human Rights to the satisfaction
of the Republic of Cyprus and Turkey formally recognises the unity,
independence, sovereignty and territorial integrity of the Republic of Cyprus
over all of its territory. During the transitional period the Government of the
Republic of Cyprus shall delegate authority over the occupied areas to the
United Nations which will act in full deference to the President of the
Republic.
