Foundation Agreement

Article 12 Past acts

2. Any claims for liability or compensation arising from acts prior to this Agreement shall, insofar as they are not otherwise regulated by the provisions of this Agreement, be dealt with by the constituent state from which the claimant hails.

 

Comments

This article in conjunction with the entire agreement purports to deny the people of Cyprus access to the European Court of Human Rights for violations of their right perpetrated by Turkey during and after its illegal invasion and occupation of Cyprus and cannot possibly be condoned in any way shape or form. It also seeks to deny justice by braking the convention that a case is dealt with in the place a crime was committed. Paragraph 2 must therefore be amended.

Amendment Required

 

“2. No provision of this Agreement shall in any way shape or form deny or interfere with the right of anyone to apply to the European Court of Human Rights for redress  or compensation arising from acts prior to this Agreement. Any claims for redress or compensation arising from acts prior to this Agreement shall be dealt with on the basis of the law by the federal authorities which shall support and assist all claims made to the ECHR.”
